Accelerated Rehabiliatative Disposition (ARD)
Accelerated Rehabilitative Disposition (“ARD”) is a program that was specifically designed to both rehabilitate criminal offenders and lead to the prompt disposition of charges. The types of offenses contemplated are “minor,” and the program was generally designed for first-time criminal offenders, affording them a “fresh start.” The determination of eligibility rests with the District Attorney, who makes the recommendation to the court concerning each case.
In order to be considered for entry into the Franklin County ARD program, an offender must complete an ARD application and submit it to the District Attorney’s Office. Offenders must meet certain eligibility requirements and enter the program on their Mandatory Arraignment Date. Upon entering into ARD an offender must sign an explanation of the ARD program and an acknowledgement that they are giving up certain rights. The offender will not be admitted into ARD until they understand and sign this acknowledgment. Offenders who are represented by a criminal defense attorney will review the ARD forms with their attorney. Those offenders choosing to proceed without an attorney will execute a waiver of their right to counsel and will review the ARD forms with an attorney from the Franklin County District Attorney’s Office.
There is no right to be offered or admitted into ARD. The District Attorney has set certain requirements that must be met to be considered for admission.
